Pension Sharing on Divorce
As a result of the Welfare Reform and Pensions Act 1999, pension rights of either spouse will now be able to be split between the parties at the date of the financial settlement. These changes took effect from 1st December 2000.
In addition to this new method of sharing, pension rights can continue to be settled by either of the two previous methods, 'offset against other assets in the financial settlement, or subject to an earmarking/attachment order
